These Terms of Service ("Terms") govern your access to and use of the websites, applications, digital products, and store operated by Heftii, Inc. ("Heftii", "we", "our", or "us"). By accessing our services or purchasing a product, you agree to these Terms. If you do not agree, do not use our services.

1. Who We Are

Heftii, Inc. develops and sells software applications and plugins. These Terms apply to all of our products unless a particular product is accompanied by its own separate terms or licence, in which case those product-specific terms take precedence for that product to the extent of any conflict.

2. Eligibility and Acceptable Use

You must be able to form a legally binding contract to use our services. You agree to use our services only for lawful purposes and not to:

  • Copy, redistribute, resell, sublicense, or make our products available to third parties except as expressly permitted;
  • Reverse engineer, decompile, or attempt to derive source code, except to the extent this restriction is prohibited by applicable law;
  • Circumvent, disable, or interfere with security-related features, download protection, or licensing;
  • Use our services in any way that infringes the rights of others or violates any applicable law.

3. Purchases and Payment

Prices for products are shown at the point of purchase and are stated in US dollars unless indicated otherwise. Payments are processed by our payment processor, Stripe; by completing a purchase you also agree to Stripe's terms. We do not receive or store your full payment card details. You are responsible for any taxes that may apply to your purchase unless we are required to collect them.

4. Digital Products and Licence

Our store sells digital products, delivered electronically via a download link. Subject to your compliance with these Terms and any product-specific licence, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the product for your own use. We (or our licensors) retain all intellectual property rights in the products; nothing in these Terms transfers ownership to you.

Some products depend on third-party software or hardware to function (for example, a plugin that controls a separate, licensed application). You are responsible for obtaining and licensing any such third-party requirements, which are listed on the product page. We are not affiliated with or endorsed by those third parties unless expressly stated.

5. Downloads and Access

After purchase, we provide a download link for your product. Download links may be time-limited for security reasons. If a link expires or you need to download a product again, you can request a fresh link using the email address you purchased with via our re-download page.

6. Refunds

Because our products are digital goods delivered immediately, purchases are generally non-refundable once the product has been downloaded. If a product is defective, materially fails to work as described, or you have not yet downloaded it, contact us at hello@heftii.com and we will work with you in good faith to resolve the issue, including issuing a refund where appropriate. Nothing in this section limits any statutory rights you may have that cannot be excluded under applicable law.

7. Updates and Availability

We may update, change, or discontinue any product or feature at any time. We do not guarantee that any product will be compatible with future versions of third-party software, hardware, or operating systems, or that our services will be available uninterrupted or error-free.

8. Disclaimer of Warranties

Our services and products are provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our products will meet your requirements or operate without interruption or error.

9. Limitation of Liability

To the maximum extent permitted by law, Heftii, Inc. and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or relating to your use of (or inability to use) our services or products. Our total liability for any claim relating to a product will not exceed the amount you paid for that product.

10. Indemnification

You agree to indemnify and hold harmless Heftii, Inc. from any claims, damages, or expenses arising out of your breach of these Terms or your misuse of our services or products.

11. Privacy

Your use of our services is also governed by our Privacy Policy, which explains how we handle your information.

12. Changes to These Terms

We may update these Terms from time to time. We will post any changes on this page and update the date above. Your continued use of our services after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, unless applicable law requires otherwise.
